Terms and Conditions

1. Introduction

These Terms and Conditions govern the provision of property maintenance and refurbishment services by Instant Maintenance Services ("IMS", "we", "us", "our") to clients ("you", "the client"). By engaging our services, you agree to these terms.

2. Quotations and Acceptance

All quotations are provided in writing and are valid for 30 days from the date of issue unless otherwise stated. A quotation does not constitute a contract. A contract is formed when IMS issues a written acceptance of an order or commences work. We reserve the right to refuse or withdraw from any contract at our discretion.

3. Scope of Works

Works will be carried out as described in the agreed specification. Any additional works required that are not within the agreed scope will be quoted for separately. IMS will not proceed with additional works without prior client approval, except in cases of immediate safety risk where we will endeavour to contact the client first.

4. Access and Site Conditions

The client is responsible for ensuring reasonable access to the property at the agreed times. Where access is not provided and our team cannot proceed, a call-out charge may apply. The client is also responsible for informing IMS of any known hazards, asbestos, or other site conditions that may affect the safe completion of works.

5. Payment Terms

Payment terms are as specified in the quotation or agreement. Standard terms are payment within 14 days of invoice. For larger projects, stage payments may be agreed. IMS reserves the right to charge interest on late payments at the rate of 8% per annum above the Bank of England base rate, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

6. Materials and Supply

Where IMS supplies materials as part of the contract, these will be specified or agreed with the client. IMS accepts no liability for defects in client-supplied materials. Risk in materials supplied by IMS passes to the client on delivery to site.

7. Workmanship Guarantee

IMS guarantees all workmanship for a period of 12 months from the date of practical completion, unless otherwise agreed. This guarantee does not cover damage resulting from misuse, neglect, or third-party interference. Manufacturer warranties on materials and products are separate and are passed through to the client.

8. Liability

Our total liability to you in connection with any contract shall not exceed the total value of that contract. We exclude all liability for loss of profits, loss of business, or indirect or consequential loss. Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, or for fraud.

9. Insurance

IMS holds Public Liability Insurance and Employers' Liability Insurance. Details of our insurance coverage are available on request. All subcontractors engaged by IMS are required to hold appropriate insurance for the work they carry out.

10. Cancellation

Where a client cancels a confirmed order, IMS reserves the right to charge for any preparatory costs, materials ordered, or time allocated to the project. A minimum charge may apply. Where IMS cancels a contract (other than for client default), we will provide reasonable notice and refund any prepayments for works not commenced.

11. Disputes

If you have a complaint or dispute, please contact us in the first instance at info@instantmaintenance.co.uk. We will endeavour to resolve all disputes within 14 working days. These terms are governed by English law and any disputes are subject to the exclusive jurisdiction of the courts of England and Wales.

12. Variations

These Terms and Conditions may be varied by IMS from time to time. The current version will always be published on our website. Continued engagement of our services following any variation constitutes acceptance of the updated terms.
